West Fraser Timber Co. has been informed that on February 3, 2005, an application was filed on behalf of the Burns Lake Native Development Corporation to the Canadian Competition Tribunal. The application makes a request to have the Consent Agreement entered into between West Fraser and the Competition Commissioner on December 7, 2004 rescinded or varied. The agreement required West Fraser to divest itself of certain assets, including its interest in sawmills located in Burns Lake and Decker Lake, as well as related timber harvesting rights in which the Burns Lake Native Development Corporation also has an interest. West Fraser is as of yet, uncertain as to how the situation will play out.
